Arbitration proceedings encounter different obstacles when one of the parties is insolvent. Effectiveness and scope of the arbitration agreement are in question, arbitration proceedings have to be coordinated with the insolvency proceedings, and conflict of laws issues are given particular weight. This applies equally to national and international arbitration. Speakers from both the insolvency law and arbitration law worlds will address the issues associated with this topic.
The Center for International Dispute Resolution at Bucerius Law School, the University of Hamburg and the University of São Paulo invite you to join the debate on arbitration and insolvency.
